Refqah is a director, attorney and conveyancer and manages the Claremont branch where she is based. After 10 years of successful practice, Refqah merged her firm with STBB in 2008. She is the national head of STBB’s Wills, Estates, Trusts and Curatorships department. Refqah also specialises in conveyancing and all aspects of property law, as well as Islamic wills and estate planning. Refqah recruits and mentors STBB’s Western Cape candidate attorneys. She is a trustee of the South African College Schools (SACS) Endowment Trust. Refqah is married to design architect Imraan Ho-Yee and they live in the Southern Suburbs with their sons.

From the desk of Refqah | Second Dwelling on a Property

Effective 1 July 2016, in terms of the City of Cape Town Municipal Planning By-law, 2015 (as amended), all properties which fall within the City of Cape Town Municipality and which are zoned SINGLE RESIDENTIAL 1 (SR1), have an additional use right to erect a second dwelling on such property (within applicable building regulations).

Should your SR1-zoned property have a restrictive title deed condition prohibiting more than one dwelling, an electronic application first has to be made to the Municipality to have such condition removed.
