I’VE COME UP WITH THE MONEY! IS IT TOO LATE TO STOP EXECUTION SALE OF MY PROPERTY?
Van der Vyver N.O. and Others v Oos Vrystaat Kaap Bedryf Beperk and Another (5859/2015) ZAECGHC 47 (21 June 2016)
The interesting question posed in this judgment was whether a judgment debtor could insist on staying an execution sale because, subsequent to the valid court order, he managed to secure financing with which to pay the outstanding debt.
SPOLIATION OF ADVERTISING SPACE ON BUILDING
Strawberry Worx Pop (Pty) Ltd v Cedar Park Properties 39 (Pty) Ltd and Another (18810/2016) ZAGPPHC 547 (17 June 2016)
This judgment serves as a reminder of one of the cornerstones of our legal system: one may not take the law into your own hands. So, where a building owner takes down advertising bill boards of a sublessee whose agreement with the owner had allegedly terminated, would our law allow the owner to take down the billboards without more?
