NEWSFLASH | POPIA and the recent notice from the Information Regulator

On the 11th of this month, the Information Regulator issued a notice postponing the coming into effect of parts of section 58 of POPIA. This relates specifically to the process which stipulates that a formal application must be made to the Regulator for the “further processing” of personal data, e.g. processing for purposes other than those for which the data had been collected.

It  therefore does not affect the rest of the provisions of the Act which are, still, coming into effect on 1 July 2021. Although it is in the powers of the Regulator to grant a further 6 months extension for the general coming into effect of the Act, no such Notice has been issued.
