There are some options available to a home owner who wants to remove conditions from their property’s title deed.<\/p>\n

Generally the process is determined by ascertaining in whose favour the condition is registered. If, for example, it is in favour of a neighbour, cancellation can be registered after the two owners entered into a notarial deed of cancellation. If the condition is in favour of the relevant local authority, application must be made to the local authority. Other conditions may be removed by way of an application to the High Court for a court order that the title condition be removed.<\/p>\n
