{"id":44629,"date":"2026-04-08T10:25:42","date_gmt":"2026-04-08T08:25:42","guid":{"rendered":"https:\/\/stbb.co.za\/dev2\/?p=44629"},"modified":"2026-04-11T05:55:21","modified_gmt":"2026-04-11T03:55:21","slug":"newsflash-the-fic-issues-directive-11-on-2026-risk-and-compliance-return-submissions","status":"publish","type":"post","link":"https:\/\/stbb.co.za\/dev2\/newsflash-the-fic-issues-directive-11-on-2026-risk-and-compliance-return-submissions\/","title":{"rendered":"Newsflash | The FIC issues Directive 11 on 2026 risk and compliance return submissions"},"content":{"rendered":"<p>Last week, the Financial Intelligence Centre (\u2018the FIC\u2019) gazetted <a href=\"https:\/\/stbb.co.za\/dev2\/wp-content\/uploads\/2026\/04\/STBB_Newsflash_April_2026-GG_No.54439_Vol.729_31March2026-Directive-11.pdf\" target=\"_blank\" rel=\"noopener\"><u>Directive 11 of 2026<\/u><\/a> (\u2018the Directive\u2019) following a public consultation process. The Directive, which incorporates appropriate public feedback, came into effect on 1<sup>st<\/sup> April 2026 and governs the submission of the 2026 risk and compliance returns.<\/p>\n<p>In essence, the Directive is a key supervisory tool that obliges specified accountable institutions to submit an electronic risk and compliance return (\u2018RCR\u2019), inclusive of questionnaires, via the FIC\u2019s online platform. To that end, the RCR assesses:<\/p>\n<ul>\n<li>An institution\u2019s exposure to money laundering, terrorist financing and proliferation financing risks; and<\/li>\n<li>Implementation of current risk-based controls in compliance with their statutory obligations under the Financial Intelligence Centre Act (\u2018the FIC Act\u2019).<\/li>\n<\/ul>\n<p>Crucially, the Directive applies to accountable institutions listed under Schedule 1 to the FIC Act, including estate agents and legal practitioners, but excludes mutual banks and co-operative bank credit providers.<\/p>\n<p>With the submission period opening on 4<sup>th<\/sup> May 2026, estate agents, legal practitioners, and others, are required to electronically submit their completed RCRs for the information period of 1<sup>st<\/sup> April 2023 to 31<sup>st<\/sup> March 2026, both dates inclusive, on or before 31<sup>st<\/sup> July 2026. All responses must be accurate, complete, and based on the institution\u2019s actual risk assessment and control environment.<\/p>\n<p>Failure to comply with the Directive renders an institution non-compliant and may result in the imposition of penalties and other administrative sanctions.<\/p>\n<p>To support the effective implementation of the Directive, the FIC simultaneously published <a href=\"https:\/\/stbb.co.za\/dev2\/wp-content\/uploads\/2026\/04\/STBB_Newsflash_April_2026-Draft_Public_Compliance_Communication_125-of-2026.pdf\" target=\"_blank\" rel=\"noopener\"><u>Draft Public Compliance Communication 125 of 2026<\/u><\/a> (\u2018Draft PCC 125\u2019).
