{"id":44322,"date":"2026-03-11T10:26:47","date_gmt":"2026-03-11T08:26:47","guid":{"rendered":"https:\/\/stbb.co.za\/dev2\/?p=44322"},"modified":"2026-03-11T10:28:04","modified_gmt":"2026-03-11T08:28:04","slug":"enhancing-conveyancing-practice-chief-registrar-releases-four-crcs","status":"publish","type":"post","link":"https:\/\/stbb.co.za\/dev2\/enhancing-conveyancing-practice-chief-registrar-releases-four-crcs\/","title":{"rendered":"Enhancing conveyancing practice: Chief Registrar releases four CRCs"},"content":{"rendered":"<p>Intended to clarify and streamline conveyancing practice, the Chief Registrar recently issued a series of Chief Registrar\u2019s Circulars (\u2018CRCs\u2019) \u2013 the first of 2026 \u2013 following a meeting with elected officials.<\/p>\n<p>Following <a href=\"https:\/\/stbb.co.za\/dev2\/conveyancing-correspondent-understanding-the-latest-amendments-to-the-deeds-registries-act-regulations\/\" target=\"_blank\" rel=\"noopener\"><u>notable amendments to the Regulations under the Deeds Registries Act<\/u><\/a>, which took effect on 1<sup>st<\/sup> March 2026, <a href=\"https:\/\/stbb.co.za\/dev2\/wp-content\/uploads\/2026\/03\/STBB_ConveyancingCorrespondent_March_2026_s2-CRC-1-of-2026.pdf\" target=\"_blank\" rel=\"noopener\"><u>Chief Registrar\u2019s Circular 1 of 2026<\/u><\/a> (\u2018CRC 1\u2019) briefly outlines the nature and impact of the revised regulatory provisions on Deeds Office practice. Specifically, CRC 1 discusses the description of undivided shares, notifying the Surveyor-General of servitudes that are registered without diagrams, and the inspection of Deeds Office records.<\/p>\n<p><a href=\"https:\/\/stbb.co.za\/dev2\/wp-content\/uploads\/2026\/03\/STBB_ConveyancingCorrespondent_March_2026_s2-CRC-2-of-2026.pdf\" target=\"_blank\" rel=\"noopener\"><u>Chief Registrar\u2019s Circular 2 of 2026<\/u><\/a> (\u2018CRC 2\u2019) focuses on the prohibition of ceding personal servitudes pursuant to section 66 of the Deeds Registries Act. Citing a contradiction between a long-standing Registrar\u2019s Conference Resolution (&#8216;RCR&#8217;) and an older court case, CRC 2 suspends RCR 15 of 2003 with immediate effect.<\/p>\n<p>Similarly, <a href=\"https:\/\/stbb.co.za\/dev2\/wp-content\/uploads\/2026\/03\/STBB_ConveyancingCorrespondent_March_2026_s2-CRC-3-of-2026.pdf\" target=\"_blank\" rel=\"noopener\"><u>Chief Registrar\u2019s Circular 3 of 2026<\/u><\/a> (\u2018CRC 3\u2019) suspends RCR 4 of 2025, which deals with how to calculate registration fees when a lease does not state the total consideration. This move may potentially require an amendment to item 1(d) to provide for the calculation of the registration fee on the <em>term<\/em> of the lease agreement as opposed to its consideration.
