Recently, the Western Cape High Court was tasked with considering the legal effect of issuing a talaq<\/em> \u2013 after formal proceedings to end the marriage have been instituted under the Divorce Act \u2013 on the application for interim relief pending divorce. In a judgment that reaffirms the application of the Divorce Amendment Act to Muslim marriages<\/u><\/a>, the court decisively ruled that issuing a talaq<\/em> in accordance with the tenets of Islam cannot oust a court\u2019s jurisdiction to dissolve a marriage or grant interim relief.<\/p>\n

The facts of the case<\/strong><\/p>\n

In an important judgment in the context of Muslim divorce, S.W. v A.L.<\/em><\/u><\/a> posed a key question: Can a talaq<\/em> issued after the commencement of Divorce Act proceedings extinguish the High Court\u2019s jurisdiction to dissolve the marriage or to grant interim maintenance under Rule 43?<\/p>\n

In 2019, the parties were married in accordance with Muslim rites and Shariah law. Following a breakdown of the marriage, the applicant instituted divorce proceedings in the Western Cape High Court on 27th<\/sup> March 2025. The following week, the respondent issued the applicant with a written talaq<\/em>, which constitutes a Muslim husband\u2019s unilateral repudiation of the marriage. As such, the respondent contended that, in accordance with the precepts of Islam, the talaq<\/em> immediately terminated the marriage, extinguished his maintenance obligations to the applicant after the expiry of the iddah<\/em> (mourning) period, and rendered the divorce summons moot.<\/p>\n

What is the legal effect of issuing a talaq<\/em> once divorce litigation has commenced?<\/strong><\/p>\n

While a valid talaq<\/em> pronounced by a husband in a Muslim marriage dissolves that marriage under Islamic law, the court rejected the respondent\u2019s \u2018misguided\u2019 argument. Under South African law, a talaq<\/em> issued after the institution of a divorce action under the Divorce Act does not nullify that action. This position derives from the Divorce Amendment Act (\u2018the Amendment Act\u2019), which expressly brings Muslim marriages within the scope of the Divorce Act<\/u><\/a>.<\/p>\n
