{"id":43478,"date":"2025-10-21T09:57:50","date_gmt":"2025-10-21T07:57:50","guid":{"rendered":"https:\/\/stbb.co.za\/dev2\/?p=43478"},"modified":"2025-10-21T09:55:00","modified_gmt":"2025-10-21T07:55:00","slug":"all-about-property-does-a-mixed-use-building-with-residential-and-commercial-components-require-an-epc","status":"publish","type":"post","link":"https:\/\/stbb.co.za\/dev2\/all-about-property-does-a-mixed-use-building-with-residential-and-commercial-components-require-an-epc\/","title":{"rendered":"All About Property | Does a mixed-use building with residential and commercial components require an EPC?"},"content":{"rendered":"<p>In a follow-up to <a href=\"https:\/\/stbb.co.za\/dev2\/all-about-property-epc-compliance-december-deadline-looms-for-commercial-property-owners\/\" target=\"_blank\" rel=\"noopener\"><u>our previous article on EPC compliance<\/u><\/a>, and in light of the fast-approaching compliance deadline, this article helpfully outlines when owners of mixed-use buildings that contain both residential and commercial components may be required to publicly display an energy performance certificate (\u2018EPC\u2019).<\/p>\n<p><strong>Legal framework<\/strong><\/p>\n<p>Intended to enhance energy efficiency, South Africa\u2019s Regulations for the Mandatory Display and Submission of Energy Performance Certificates for Buildings (\u2018the Regulations\u2019) require both privately owned and state-occupied buildings to obtain and publicly display an EPC if all of the following conditions are met:<\/p>\n<p><em>Occupancy classification<\/em><\/p>\n<p>As per Regulation A20 of the National Building Regulations, the building\u2019s dominant occupancy must fall under a specified occupancy class, namely:<\/p>\n<ul>\n<li>A1 \u2013 Entertainment and public assembly<\/li>\n<li>A2 \u2013 Theatrical and indoor sport<\/li>\n<li>A3 \u2013 Places of instruction<\/li>\n<li>G1 \u2013 Offices<\/li>\n<\/ul>\n<p><em>Operational status<\/em><\/p>\n<p>The building must have been operating for at least two years without major renovations during that time.<\/p>\n<p><em>Size threshold<\/em><\/p>\n<p>The total net floor area must exceed 2 000 m<sup>\u00b2<\/sup> (for privately owned buildings) or 1 000 m<sup>\u00b2<\/sup> (for those owned or occupied by an organ of state).<\/p>\n<p><strong>How do these requirements apply to mixed-use buildings?<\/strong><\/p>\n<p>For mixed-use buildings, such as offices above residential apartments or retail below flats, the Regulations require a more nuanced assessment. Each area of the building is classified separately according to its dominant function.<\/p>\n<p>The Department of Mineral Resources and Energy and the South African National Energy Development Institute (\u2018SANEDI\u2019) have clarified that, when assessing a mixed-use building, owners should ask three key questions:<\/p>\n<ol>\n<li>Does the portion of the building that falls under an EPC-relevant classification (A1, A2, A3, or G1) exceed 2 000 m<sup>\u00b2<\/sup>?<\/li>\n<li>Can this commercial component be clearly separated from the residential areas? In other words, is it possible to establish a clear boundary around these portions?<\/li>\n<li>Does the commercial component account for more than 10% of the building\u2019s total energy consumption?<\/li>\n<\/ol>\n<p>If all three answers are \u2018yes\u2019, that commercial portion must obtain an EPC \u2014 even if the rest of the building (for example, the residential component) does not.<\/p>\n<p><strong>Do hotels require an EPC?<\/strong><\/p>\n<p>It is crucial to note that owners of buildings classified as H1 \u2013 Hotel, namely buildings where individuals rent furnished units, as well as H5 \u2013 Hospitality, being those buildings where unrelated individuals transiently rent furnished rooms in domestic residence or dwelling house not exceeding 16 persons, are not mandated to obtain an EPC.<\/p>\n<p>In instances where the building that includes hotel or hospitality has a mixed occupancy, each component must be separately classified and assessed in line with the questions above.<\/p>\n<p><strong>How can building owners apply for an EPC?<\/strong><\/p>\n<p>In South Africa, owners of commercial buildings and qualifying mixed-use buildings must acquire the services of an accredited inspection body to conduct an evaluation of the building and issue a certificate before the looming deadline of 7<sup>th<\/sup> December 2025.<\/p>\n<p>For further information, visit <a href=\"https:\/\/epc.sanedi.org.za\/home\" target=\"_blank\" rel=\"noopener\"><u>SANEDI\u2019s website<\/u><\/a>.<\/p>\n<p>For all commercial and residential property-related queries, contact our team of real estate attorneys at <a href=\"mailto:info@stbb.co.za\/dev2?Subject=STBB%20All%20About%20Property%20Does%20a%20mixed-use%20building%20with%20residential%20and%20commercial%20components%20require%20an%20EPC%20enquiry\"><u>info@stbb.co.za\/dev2<\/u><\/a>.<\/p>\n<p style=\"font-size: 12px; text-align: left;\"><em>This content is the property of STBB.
