Development law update: SCA dismisses municipality\u2019s appeal in split zoning matter<\/strong><\/p>\n

In a previous edition of All About Property<\/em>, we explored a Western Cape developer\u2019s successful appeal<\/u><\/a> against a decision of the George Local Municipality concerning the disputed split zoning of its sawmill operation on the eastern border of the city. In that matter, the High Court found that the Municipality had unreasonably refused to correct a clerical error on its new zoning map, which limited development.\u00a0 Dissatisfied with the court’s ruling, the Municipality approached the Supreme Court of Appeal, which dismissed the appeal<\/u><\/a>.<\/p>\n
