Daar is geen Suid-Afrikaanse wetsgesag vir die geldigheid van \u2018n\u00a0 video-testament nie. Vir ‘n testament om geldig geag en deur die Meester van die Hooggeregshof aanvaar te word, moet dit voldoen aan die vereistes soos uiteengesit in die Wet op Testamente van 1953. Dit sluit in, onder meer, die vereiste dat dit behoorlik deur die testateur en minstens twee bekwame getuies (wat terselfdertyd teenwoordig is) onderteken moet word.<\/p>\n

Die kwessie rakend die geldigheid van videotestamente het reeds voor die howe van verskeie internasionale jurisdiksies (byvoorbeeld Nieu-Suid-Wallis, Australi\u00eb en in enkele Amerikaanse state) gekom, en daar is in sommige uitsprake bevind dat video-testamente in sekere gevalle en mits daar aan spesifieke vereistes voldoen word, as ‘n geldige laaste testament van ‘n oorledene aanvaar kan word. Dit blyk dus dat internasionale jurisdiksies geleidelik aanpas soos hul howe die wisselwerking tussen die wet en tegnologiese vooruitgang navigeer.<\/p>\n

Ons kan egter nie genoeg benadruk hoe belangrik dit is om in Suid-Afrika ‘n geskrewe, deeglik uitgevoerde testament te h\u00ea, ongeag die moontlikheid dat video-testamente in die toekoms goedgekeur kan word.<\/p>\n
