Aanbod en aanvaarding is \u2018n fundementele element van die Suid-Afrikaanse kontraktereg. Daar moet, met ander woorde, ‘n geldige aanbod en ‘n geldige aanvaarding van daardie aanbod wees voordat \u2018n afdwingbare kontrak in die lewe geroep is.<\/p>\n

Dit gebeur dikwels dat een party (die aanbieder) aan ‘n ander party (die ontvanger) ‘n aanbod maak wat \u2018n tydsbeperking stipuleer waarbinne die aanbod aanvaar moet word. As aanvaarding dan nie binne die ooreengekome tydperk geskied nie, verval die aanbod en is dit verder van geen regskrag nie. Andersins gebeur dit ook dat ‘n aanbod geen sodanige afsnydatum stipuleer nie. Ons sal na die eersgenome soort aanbod as ‘n ‘tydsensitiewe aanbod’ verwys en na die laasgenoemde as ‘n ‘oop aanbod’.<\/p>\n
