\u2018n Veiling kan beskryf word as \u2018n publieke aangeleentheid waartydens goedere of eiendom aan die hoogste bie\u00ebr verkoop word. Bankinstellings gebruik al vir baie jare veilings om die verkoop van eiendom ten opsigte waarvan uitvoeringsverkoping deur \u2018n hofbevel goedgekeur is, suksesvol te bewerkstellig. Deesdae kies \u2018n toenemende hoeveelheid \u00a0privaat verkopers ook om hul eiendom op die manier te verkoop, omdat hulle onder die indruk verkeer dat \u2018n veiling meer belangstelling by voornemende kopers sal trek.<\/p>\n

Eiendom wat op \u2018n veiling verkoop word, word gewoonlik\u00a0voetstoots<\/i>\u00a0verkoop. Dit wil s\u00ea dat die eiendom \u2018soos dit is\u2019 verkoop word, met sigbare en onsigbare gebreke inkluis. Gevolglik het kopers selde regsremedies tot hul beskikking as hulle ten einde ontevrede is met die toestand van die eiendom wat hul gekoop het. In di\u00e9 opsig is dit belangrik om op te let dat verbruikers se regte op \u2018veilige, goeie gehalte goedere\u2019 ingevolge Artikel 55 van die Wet op Verbruikersbeskerming nie van toepassing is op goedere wat by \u2019n veiling gekoop is nie.<\/p>\n

Daarom is dit noodsaaklik om aandagtig te wees op die volgende, mits u eiendom op \u2018n veiling wil bekom:<\/p>\n

    \n
  1. Inspekteer die eiendom;<\/li>\n
  2. Verkry ‘n afskrif van die verkoopsvoorwaardes;<\/li>\n
  3. Doen navraag oor of die eiendom tans verhuur word;<\/li>\n
  4. As die eiendom ‘n eenheid in ‘n deeltitelskema is, doen navraag oor die bedrag van die maandelikse heffings en tariewe;<\/li>\n
  5. Verkry ‘n afskrif van die titelakte en relevante goedgekeurde diagramme, sodat u vertroud is met enige voorwaardes of serwitute op die eiendom. Alhoewel die dokumente selde deur afslaers aan voornemende kopers beskikbaar gestel word, kan u altyd die afslaer vooraf vra om die dokumente beskikbaar te maak, \u2018n web-soek doen of u transportbesorger nader om die verlangde dokumente te bekom.<\/li>\n<\/ol>\n

    Daar is gewoonlik \u2018n vooraf deposito betaalbaar, wat as ‘n persentasie van die koopprys bereken word. Verder sal u heel moontlik vir die kommissie van die afslaer sowel as die uitstaande tariewe en belasting verantwoordelik wees.<\/p>\n

    Veilings word oor die algemeen met ‘n reserweprys aangebied. Indien dit die geval is en die hoogste aanbod nie die reserwe bedrag bereik nie, dan sal die verkoop van die eiendom eers deur die verkoper bevestig moet word.<\/p>\n

    Verder is dit is belangrik om daarop te let dat die verkoper verskeie regsremedies tot sy of haar beskikking het indien die koper kontrakbreuk pleeg. Die mees algemene klousules in die opsig is die volgende, of iets in dier voege:<\/p>\n

    1. Die verkoper is geregtig om die ooreenkoms met skriftelike kennisgewing te kanselleer en skadevergoeding te eis as gevolg van die kontrakbreuk;<\/li>\n
    2. Die verkoper is geregtig om onmiddellik betaling van die volle koopprys en spesifieke nakoming tee is.<\/li>\n<\/ol>\n

      Indien skadevergoeding ge\u00ebis word, is dit baie moontlik dat die deposito en agentekommissie wat reeds vooraf betaal is, verbeur word.<\/p>\n

      Dit is dus noodsaaklik dat u die nodige navrae doen en bewus is van moontlike struikelblokke, sodoende te voorkom dat u die aankoop berou.\u00a0<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"
