Eiendomsontwikkelaars en eienaars soek dikwels advies rakende die beste tydverdelingskema om te gebruik in \u2018n eiendomsontwikkeling.Die keuse hang af van die eienaar of ontwikkelaar se mikpunt.<\/p>\n

Een opsie is om \u2018n aandeleblokskema op te rig. \u2018n Aandeleblokskema word in die Wet op Beheer van Aandeelblokke Nr. 59 van 1980 omskryf as \u2018n skema waarkragtens \u2018n aandeel in \u2018n maatskappy \u2018n belang (of reg) op die gebruik van onroerende eiendom verleen. \u2018n Aandeleblokmaatskappy is \u2018n spesiale soort maatskappy wat die eienaar van die relevante eiendom is (d.w.s. deur die oordrag van die betrokke grond ) \u00f3f \u00a0wat die grond by die eienaar huur.<\/p>\n

Gebruiksregte ten opsigte van die grond word dan deur die aandeleblokmaatskappy aan sy aandeelhouers toegeken deur sodanige gebruiksregte op te neem in die akte van oprigting van die maatskappy en in \u2018n gebruiksooreenkoms wat tussen die aandeleblokmaatskappy en al sodanige aandeelhouers aangegaan is op min of meer identiese terme.
\nBy die opstel van hierdie skema, moet eienaars en ontwikkelaars let op die volgende:<\/p>\n

    \n
  1. die aandeleblokmaatskappy mag nie aandele uitreik wat die reg op of die belang in die gebruik van grond of geboue daarop aan die publiek verleen voordat dit ingevolge die Maatskappyewet Nr. 71 van 2008 as \u2018n aandeelblokmaatskappy opgeneem is nie;<\/li>\n
  2. geen vergoeding mag deur die ontwikkelaar, eienaar of aandeleblokmaatskappy ontvang word ten opsigte van \u2018n aandeleblok nie alvorens \u2018n sertifikaat van praktiese voltooiing ten opsigte van die geboue deur \u2018n argitek uitgereik is nie. Een van die uitsluitings hierop is die ontvangs van vergoeding deur \u2018n aandeelblokontwikkelaar. Die ontwikkelaar se hoofbron van finansiering vir die ontwikkeling van \u2018n aandeleblokskema is gewoonlik \u2018n verbandlening van \u2018n finansi\u00eble instelling. Die maatskappy is afhanklik van bydraes van sy aandeelhouers om sy verpligting om die lening terug te betaal, na te kom en daarom is dit belangrik dat die akte van oprigting die aandeelhouers verplig om maandelikse kontantbydraes te maak vir die maatskappy om dit te gebruik vir die leningsverpligting.<\/li>\n<\/ol>\n","protected":false},"excerpt":{"rendered":"
